We use the three-month average price per gallon of diesel fuel as published by the U.S. Department of Energy on its web site at http://www.eia.doe.gov to calculate applicable fuel surcharge for the preceding three month period. For example, according to DOE Report, the national average price of diesel fuel for the months of December 2007, January and February 2008 were $3.34, $3.30 and $ 3.37 respectively. Accordingly, the national average price for diesel for the three months ending February 29, 2008, was $3.34. Referring to the table set forth below, a national average price of $3.34/gallon corresponds to a fuel surcharge of $6.00/order. In calculating the national average price, [all amounts] shall be rounded to the nearest dime.
The initial service charge shall commence effective April 16, 2008, and shall remain in effect until June 30, 2008. In June 2008, we will calculate the service charge for the period July 1st - September 30th, 2008, by reference to the average national prices on the DOE Report for March, April and May 2008. Thereafter, the fuel surcharge shall be recalculated in accordance with the schedule set forth below.
